فيديو: شربل نحاس يتحدث عن العاملات الاجنبيات في الخدمة المنزلية



يتحدث الأستاذ شربل نحاس عن الاطار القانوني الذي يرعى وضع العاملات الأجنبيات في الخدمة المنزلية، ويؤكد نحاس انه لا يوجد في لبنان نظام قانوني خاص بهذه الفئة العاملة وبالتالي لا وجود "لنظام الكفالة". كما ويسرد الأستاذ شربل تاريخ وجود العاملات في الخدمة المنزلية في لبنان وبداية استقدام العاملات الأجانب في أواخر الستينات والعوامل التي دعت لهذا الاستقدام.
مداخلته هي جزء من الجلسة التي نظمتها حركة مناهضة العنصرية مع وزير العمل السابق شربل نحاس يوم الاثنين 11 شباط 2013 في مقهى نسوية في بيروت-لبنان. وقد حاضر شربل نحاس في نظام الكفالة في لبنان. هذا النظام الذي يحكم العلاقة بين أصحاب العمل وعاملات المنزل الأجنبيات يستضعف العاملات الأجنبيات ويعرّضهن للاساءة والاستغلال ومن ثمّ يقيّدهن في هذه الحالات التعسفية.
الاستاذ شربل نحّاس ناقش عدم وجود ما يسمى بنظام الكفالة وطرح اعتماد طريقة بديلة لمعالجة الإطار القانوني الذي يحكم العمّال الأجانب في لبنان. نظام الكفالة هو احد عناصر القمع والظلم الرئيسية الذي يواجهه العمّال الأجانب في لبنان. وهو يلزمهم بصاحب عمل واحد، ينفي حقّهم بحرية التنقل والعمل ويمنح الحرية لأرباب العمل معاملة العمّال الأجانب كما يشاؤون وبلا قيود

This video is a part of an information session organized by the Anti-Racism Movement (ARM) on Monday 11th of February 2013 at the Nasawiya Café (beirut-Lebanon) with former Minister of Labor Dr. Charbel Nahas, who spoke about the sponsorship system. This system, which governs the relationship between employers and migrant domestic workers (MDWs), renders MDWs vulnerable to abuse and exploitation and then traps workers in these abusive situations.
Dr. Nahas argues that there is no such thing as the sponsorship system and proposes an alternative for addressing the legal framework governing MDWs' lives in Lebanon.
The sponsorship system is one of the main elements of oppression and injustice that MDWs face in Lebanon. It binds them to one employer, denies their right freedom of movement and employment, and grants employers the freedom to treat their employees as they please.

انضموا الى الجلسة الرابعة لحركة مناهضة العنصرية مع وزير العمل السابق شربل نحاس الذي سيحاضر في نظام الكفالة في لبنان. هذا النظام الذي يحكم العلاقة بين أصحاب العمل وعاملات المنزل الأجنبيات يستضعف العاملات الأجنبيات ويعرّضهن للاساءة والاستغلال ومن ثمّ يقيّدهن في هذه الحالات التعسفية.

Migrant Workers in Lebanon: No to Medieval Treatment

The Migrant Workers’ Parade and Festival, set for Sunday in Beirut, is seeking to “change mentalities” about foreign workers in Lebanon.
African migrant workers continue to be called fahmeh (charcoal) or abed (slave) on Lebanon’ streets. Asians can still be addressed as “Jackie Chan” or “Bruce Lee.” Arab laborers are routinely referred to as mukhabarat (informers) or as “stinkers.”

The racism practiced by part of Lebanese society against migrant workers is medieval. Yet the Lebanese state refuses to enact laws

في عيد العمّال (الأجانب)... «كفى» عنصرية

«لأن العمال الأفارقة ما زالوا ينعتون بالفحمة والعبد في شوارع لبنان، والآسيويين ما زالوا يسمّون بجاكي شان وبروس لي، والعمال العرب ما زالوا يسمون بالمخابرات والـ«طالعة ريحتهم»؛ لأنّ الدولة اللبنانية ترفض أن تشرّع قوانين تحمي العاملات والعمال الأجانب (...) حيث بعض المجتمع اللبناني ما زال يمارس عنصرية القرون الوسطى على الوافدين/ات...»، سيشهد الأحد 29 نيسان (أبريل) الجاري تظاهرةً احتجاجيّة فريدة.
«حركة مناهضة العنصريّة» وجّهت الدعوة على فايسبوك إلى الاحتفال بعيد العمّال، تكريماً لمن يربون أولادنا، وينزهون كلابنا، ويحرسون أبنيتنا، ويبنون الأبراج الشاهقة التي ترتفع في عاصمتنا. هذا العيد ليس عيداً للعمال اللبنانيين فقط، بل هو يوم لكلّ كادح يتعب لتأمين لقمة عيشه. من أحقّ بالاحتفال بهذا اليوم في لبنان من العاملات في الخدمة المنزليّة مثلاً؟ هذا ما فكّرت به الحركة بالشراكة مع جمعيّات «كفى»، و«نسويّة»، و«إنسان»، و«الرعاية الرعوية للمهاجرين الأفارقة والآسيويين PCAAM» التي ستنظّم تظاهرة تطالب بإلغاء نظام الكفالة الشبيه بأنظمة الاستعباد.

Eight organisations in Lebanon: Stop Abuse of Domestic Workers

(Beirut, 23 March 2012) – Lebanese authorities should act quickly to reform restrictive visa regulations and adopt a labor law on domestic work to address high levels of abuse and deaths among migrant domestic workers, a group of eight concerned civil society groups said today. The government should also announce publicly the outcome of the investigation into the recent abuse and subsequent suicide of Alem Dechasa-Desisa, an Ethiopian domestic worker.

The eight groups are Human Rights Watch, Caritas Lebanon Migrant Center, KAFA (enough) Violence & Exploitation, Anti Racism Movement, Amel Association International, Insan, Danish Refugee Council, and Nasawiya.

On the new draft law for regulating domestic workers in Lebanon

Discussion on Draft Law for Domestic Workers with Lawyer Mohana Isaac next Thursday

This Thursday June 2nd, at 7pm, Nasawiya is hosting a discussion at Nasawiya on the new draft law for organizing decent work for domestic workers in Lebanon. Lawyer Mohana Isaac who works with Kafa will explain the main features and critiques of the proposed law.

This Wednesday: Aimee talks about her activism with migrant women workers in Lebanon

January 12, at 7:00 p.m. at Nasawiya House in Ashrafieh- Shahrouri- Infont of Laure Mghaizel School- Braidi Bldg- 1st Flr.

Aimee is a migrant community leader from Madagascar. She has been in Lebanon for the past 13 years. She is superwoman for those who know her and work with her, an inspiration to many, a godmother to all. Aimee's involvement is not only limited to her country mates but most migrant nationalities in Lebanon.

Nasawiya is hosting Aimee to hear about her work, the cases she handles, the problems she faces, the success stories she has encountered and more.

Aimee has tons to say and there are tons we can work on together. So let us start by attending her talk and showing her as much as support as we can.

صوت النسوة: شكراً بطرس حرب، بس ما فهمنا

كتبت ربيكا صعب سعادة في "صوت النسوة" مقال بالعربية "اللبنانية" عن بعض حلول وزارة العمل لوضع الخادمات الأجانب في لبنان وعن العنصرية اللبنانية بعنوان شكراً بطرس حرب، بس ما فهمنا. ما يلي هو مقتطفات من المقال
لمّا نحكي بحقوق الإنسان والقانون، ما في شي إسمه “الشعب الفلاني لطيف”. كل الشعوب فيها الخير وأغلبية العالم عندها القدرة تكون لطيفة أو مش لطيفة وفقاً للظروف. بالنهاية الشعب الألماني إيام النازية كانت بأغلبيته “لطيف”، والشعب الإسرائيلي أنا أكيدة إنّو لطيف. بس لمّا القانون يعنّف فئات معيّنة ، الناس اللطيفة ما عندا مشكل تتصرّف متل الكواسر، هيدي ميزة إنسانية جداً ومشان هيك نحنا منشتغل للحصول على قوانين لطيفة وغير ظالمة وما منتّكل على نخوة الناس اللطيفة. مقارنة أو ربط حماية العاملات الأجنبيات بحماية أرباب العمل مقارنة مهينة وخطيرة. تعدّيات عاملات المنازل هنّي حالات فردية ومعزولة بالوقت اللّي حالات الإستغلال اللّي بتوقع العاملات ضحيتها هنّي مشكلة إجتماعية مستشرية ناتجة عن العنف القانوني الممارس من الدولة اللبنانية بحق العاملات لجعلن الحلقة الأضعف بالمجتمع اللبناني وبالتالي فشة خلق كل أفراد المجتمع. شو الفرق؟ الفرق إنّو إذا عاملة أجنبية بتشتغل بمنزل حدا ارتكبت أي خطأ، لو شو ما كان، بيقدر صاحب العمل، يأنبها، يضربها، يطردها، يتهمها بالسرقة، الخ. إذا انقلبت الآية وصاحب العمل أخطأ، شو بيطلع بإيد العاملة؟ ولا شي، ليش؟ لأنّو صاحب الشغل هوي بنفس الوقت رب العمل، والكفيل، باسبورها بإيده وهوي الرجل اللبناني…

Ethiopian Suicides and Nasawiya try to shed light on Sri Lankan maid death

On March 19, 2010, the National News Agency reported the ‘suicide’ of a Sri Lankan maid in Jal El Dib by jumping from the window of Al Rabih employment office located at the fourth floor of Hafiz Abu Jaoude building

The death was presumed to be a suicide according to the National News Agency, from which the newspapers picked up the news.

On Saturday 20th, Ethiopian Suicides and Nasawiya attempted to shed more light on this case by going to the scene of the fall and ask a few questions. To our great surprise, just like in the previous cases, the neighboring shops did not know anything. It turned out that, first new piece of information, the fall happened at night, and that the ambulance and the police came early in the morning.

When we tried to ask questions to the owner of the employment office, Al Rabih, he and the Sri Lankan man who was in the office felt seriously uncomfortable and refused to comment.

We later paid a visit to the Antelias police station where we couldn’t get much info either.

Finally, our calls to the Sri Lankan embassy were answered by a Lebanese woman who went on the defensive to reassure us that the embassy is trying to do everything it can on this issue – BEFORE we asked her about anything. The minute we asked about the Sri Lankan woman who died last week she automatically said and reiterated that it was a suicide. “We are sure it was a suicide” she said. She took our number and told us that the consul will call back in two minutes. No one called us till date.

The main question we did not find an answer to, for the past few weeks of “attempting”: Was she alone when she ‘fell’ or ‘decided to jump’ from the balcony? We doubt that.
