لبنان: إطلاق مدوّنة قواعد السلوك التي تتضمن المبادئ التوجيهية لوكالات التوظيف حول تعزيز حقوق خدم المنازل من المهاجرين وحمايتها

كجزء من الجهود التي يبذلها كل من مكتب المفوضية السامية لحقوق الإنسان (OHCHR) ومنظمة العمل الدولية (ILO) لحماية حقوق خدم المنازل في لبنان وتعزيزها ، أُطلقت مدوّنة قواعد السلوك التي تتضمن المبادئ التوجيهية لوكالات التوظيف حول تعزيز حقوق الخدم من المهاجرين وحمايها وذلك في شهر حزيران / يونيو في لبنان. تلتزم كافة وكالات التوظيف بموجب هذه القواعد حماية عمالها من كافة اشكال التمييز والانتهاك الجسدي والجنسي وغيرها من أشكال الاستغلال. يتوجب على هذه الوكالات توضيح حقوق العمال والعمالة ، والوظائف المتوقعة في بداية العقد المبرم. ويتعين عليها تعريف العمال وارباب العمل على حقوق وواجبات كل منهم والتواصل معهم بلغة يفهمها العامل. وسيجري إدراج الوكالات التي تنتهك مدونة قواعد السلوك بتسهيلها الكفالات مما يؤدي إلى السخرة والاستغلال على سبيل المثال على القائمة السوداء . تتناول بعض المبادئ الواردة في مدونة قواعد السلوك من بين أمور أخرى، ممارسة الشفافية في الأعمال التجارية ، وتوفير المعلومات الكاملة للعامل حول شروط العمل في لبنان ، والتحقق من مؤهلات العامل وعدم كفالة العمال ممن هم دون السن القانونية.

خلال مؤتمر صحافي بمناسبة إطلاق المدونة ، أبرز نضال الجردي الخبير في حقوق الانسان لدى مكتب المفوضية السامية لحقوق الانسان أهمية آلية التنفيذ والمساءلة الذتية ذات الصلة والاجراءات التأديبية. وقال مضيفا " إنه وفي ظل غياب أي إطار تنظيمي وقائي محصن من قبل الدولة لخدم المنازل ، فإن مدونة قواعد السلوك تُعد الوثيقة الوحيدة المتاحة حتى الآن القادرة على تعزيز الشفافية وعملية الكفالة لخدم المنازل من المهاجرين " .

A Code of Conduct to recruit migrant domestic workers in Lebanon

29 July 2013 - In Lebanon, people working in private households are excluded from the protection of labor law.

Although they constitute a large proportion of the workforce, they do not enjoy the same rights as, for example, local shop assistants or factory workers.

A Code of Conduct, launched in June 2013, now provides guidance to recruiting agencies on promoting and protecting the rights of migrant domestic workers in the country.

Developed in consultation with the Middle East Office of the High Commissioner for Human Rights (OHCHR) and the International Labor Organization (ILO), the Code of Conduct was jointly put together by the Lebanese Ministry of Labor, the Syndicate of Owners of Recruitment Agencies in Lebanon (SORAL) and Caritas Lebanon's Migrant Center.

The Daily Star, by Samya Kullab, June 08, 2013 - BEIRUT: The Association of Owners of Recruitment Agencies in Lebanon has adopted a self-regulating code of conduct in a bid to protect the rights of migrant domestic workers, but the question of implementation, especially among recruitment agencies operating outside of the order, remains up in the air. “We are trying to put an end to the negative stereotype that haunts our industry,” explained Hisham Bourji, the association’s president, about his group’s decision to draft the code.

The announcement of the move was made Thursday during a conference organized by the International Labor Organization, with the cooperation of the Labor Ministry.

Bourji maintains that the association was already in the habit of following an implicit protocol for proper recruitment practices, but no one was paying

جنيف (أخبار م ع د) – لقد أيد معظم المندوبين العرب في مؤتمر العمل الدولي اعتماد معياري العمل الدوليين التاريخيين بشأن العمل اللائق للعمال المنزليين، وذلك يوم الخميس (16 حزيران/يونيو)، ولم تُسجل سوى بضعة حالات امتناع عن التصويت. ولكن بعضهم قد أبرز التحديات الماثلة أمام  التصديق والتنفيذ في البلدان العربية.

تستمر في جنيف اجتماعات الدورة الـ100 لمؤتمر العمل الدولي. ويشارك لبنان في المؤتمر الذي يختتم أعماله في السابع عشر من هذا الشهر، بوفد يمثل أطراف العمل الثلاثة (الحكومة وأصحاب العمل والعمال). البند الاهم على جدول أعمال المؤتمر إقرار اتفاقية جديدة بعنوان «العمل اللائق للعمال المنزليين» تكملها توصية تتعلق بتنظيم عمل هذه الفئة من العمال، التي تعيش في العديد من البلدان في ظروف استغلال وتمييز. وتخوض المنظمات غير الحكومية الدولية حملة من لإقرار هذه الاتفاقية التي تواجه تحفظات حكومية كبيرة، ابرزها من دول مجلس التعاون الخليجي التي تستضيف ٢,١ مليون من العمالة المنزلية.

ويقدر حجم العمالة وفق الإحصاءات الرسمية بـ٥٢,٦ مليون عامل، فيما تشير التقديرات غير الرسمية الى ان العدد يتجاوز المئة مليون. اما في لبنان فيقدر العدد بين ١٣٠ و٢٠٠ ألف عامل

BEIRUT: Landmark steps to incorporate domestic workers in national labor unions got under way Thursday in meetings between United Nations representatives and regional trade-union leaders.

Some 200,000 migrant domestic workers are thought to be working in Lebanon, with millions more spread over the region, but few are afforded any tangible protection under the law. Without union representation, they are left open to a long list of abuses, including non-payment of salaries, confiscation of travel documents as well as verbal, physical and even sexual abuse.

“It is time to act to regulate the domestic-work sector through legal, administrative, and cultural measures,” said Labor Minister Boutros Harb.

أعلنت «منظمة العمل الدولية» أمس أن عدد العمال المهاجرين في المنطقة العربية يقدّر بحوالى 22 مليوناً، ثلثهم على الأقل من النساء، مشيرة إلى أن المنطقة استقبلت في العام 2008، أكثر من تسعين في المئة من العمال السريلانكيين الذين غادروا بلادهم، 45 في المئة منهم من العاملات المنزليات.
أضافت معطيات المنظمة التي تستند إلى السجلات الإدارية التي تعتبر المصدر الرئيسي للمعطيات المتوفرة، أن مليونين ومئتي ألف فيليبيني يعملون في المنطقة، مشيرة إلى أن الأندونيسيين يشكلون المجموعة الأكبر من العمّال، من دون أن توضح عددهم.
وذكرت المنظمة أن المسح في لبنان في العام 2004 قدّر عدد العمال المنزليين بتسعة وثلاثين ألفاً، أي أقل بنسبة خمسين في المئة من الرقم المقدّر بمئة ألف في بيانات وزارة الداخلية. وأشارت إلى أن 38 في المئة من العمال المنزليين العاملين في السعودية هم من الرجال.
وقد قدمت المنظمة في بيروت أمس الأرقام والملاحظات التي جمعتها من خلال عملها في الأقطار العربية المختلفة، في حين عددت سيمال أسيم من مكتب المنظمة في بيروت، سلسلة الانتهاكات التي تمارس بحق العمال واستغلالهم من قبل مكاتب الاستقدام ومستخدميهم، ومعاناتهم من التمييز وغياب القوانين الراعية لعملهم.

According to Christian Aid, the next steps for this area of work include working with partners to:

• ensure that the detail of the ILO Convention reflects the needs of domestic workers as far as possible;
• build wider and deeper support for the ILO Convention, particularly in the Middle East;
• hold governments accountable for acting on positive positions taken in the ILO process by improving national laws and practice to match these benchmarks;
• build support for the Convention and its ratification by countries in the Middle East;
• deepen the participation and organisation of domestic workers’ groups in the ILO process, other international fora, and in national contexts;
• highlight the value of domestic work and the poor conditions of many domestic workers in the Middle East;
• support our UK partners in calling for the UK government to support a substantive Convention to further the rights of domestic workers internationally.

Lebanese Minister of Labour Condemns Israel at 99th International Labour Conference, but what about migrant domestic workers?

Today in Geneva, leaders from government, labour, employers and civil society have opened discussions on the impact of the current economic and jobs crises on employment policy and the Millennium Development Goals (MDGs) at a high-level panel at the annual conference of the ILO.

Today, in the National News Agency (NNA), I read a briefing (see below in Arabic) that our Minister of Labour, Boutros Harb, will be participating to the 99th International Labour Conference in Geneva, along with workers union representatives, and representatives of employers. The briefing was headlined "Minister Harb to Speak at Labor Conference in Geneva, Will State Lebanon's Position Rejecting Israel's Intractable Excesses". The NNA briefing says, in substance, that the minister will explain at the conference Lebanon's position on local, Arab and international labour causes, and will include Lebanon's rejection of Israel's intractable excesses especially its recent aggression against the Freedom Flotilla.

Now don't get me wrong. I am for condemning and boycotting Israel until it complies with international law and human rights.

But the NNA briefing did not say anything about the minister's position on a key item on the conference's agenda: Decent work for domestic workers (standard setting, with a view to the possible adoption of a Convention supplemented by a Recommendation)

Also, the NNA briefing did not say if our minister will condemn Israel at Panel 1 on The Global Jobs Pact and macroeconomic policy moderated by Mr. Simon Long (Asia Editor of The Economist), or if he will condemn Israel at Panel 2 on the role of productive employment and social protection in realizing internationally agreed development goals and the MDGs moderated by Mr. Americo Martins dos Santos (Executive Editor for the Americas at the BBC World Service).

انطلقت، منذ الثاني من حزيران الجاري، فعاليات مؤتمر العمل الدولي، في دورته التاسعة والتسعين، الذي تنظّمه «منظمة العمل الدولية». ويشارك لبنان فيه عبر وفد مكون من ستة أشخاص انتدبتهم وزارة العمل، يتوزعون على لجان المؤتمر السبع، ينضمّ إليهم وزير العمل بطرس حرب واثنان من مستشاريه بعد غد السبت، لتلاوة كلمة لبنان والمشاركة في المباحثات حتى نهاية المؤتمر. ويترأس حرب اليوم اجتماع لجنة التسيير الوطنية التي شكّلها مجلس الوزراء السابق، لمعالجة شؤون العمال المنزليين، بعدما توقف عملها منذ حوالى السنة. وقد أنيطت بها مهمة الإعداد لمشروع قانون وكتيّب ارشادي يبصر النور قريباً، بالإضافة إلى العقد الجماعي الذي بدأ العمل به.
إلى عناوينه المعتادة، يطرح المؤتمر الدولي موضوع العمّال المنزليين على قاعدة تقرير عنوانه «العمل اللائق من أجل العمال المنزليين»، يشكل خلفية دراسية رئيسية لإبرام اتفاقية دولية ترعى حقوق هؤلاء العمال، وذلك قبيل انتهاء المؤتمر في 18 الجاري.

Action Programme for Protecting the Rights of Women Migrant Domestic Workers (WMDWs) in Lebanon (from the April 2010 ILO Arab States Gender Equality Newsletter)

The International Labor Organization (Regional Office Beirut) will soon be launching a three year Action Programme in order to contribute to improving the conditions of work for women migrant domestic workers in Lebanon. Over the course of the programme, the capacities of Ministry of Labour (MoL) and other key players will be enhanced to manage the monitoring and regulating WMDWs. A series of activities will be undertaken for enhancing the understanding of workers’ rights among the domestic workers, their employers, employment agencies, teachers and social partners under the action programme. As a key partner, the MoL is already actively engaged with the ILO RO-Beirut to disseminate an information guide on domestic migrant workers’ rights. MoL is also working toward establishing a hotline service for migrant workers.
