<a name='more'></a><br />The incident came three days after another Ethiopian domestic worker had jumped from her employer’s house on the fourth floor in Bsalim, north of Beirut. She survived the fall but was severely injured.<br /><br />According to the International Labor Organization, Lebanon is home to over 250,000 female migrant domestic workers, the majority of whom come from Sri Lanka, Ethiopia, the Philippines and Bangladesh to work as housemaids.<br /><br />Rights groups have complained that employers often withhold pay, lock workers in their homes and confiscate their passports, among other abuses.<br /><br />The harsh living conditions have pushed some migrant workers to commit suicide. Others have died or been seriously injured while trying to escape the employers’ residences.<br /><br />In 2008, Human Rights Watch recorded one migrant domestic worker death per week from unnatural causes, including suicide.<br /></div>

Home to some 200,000 migrant domestic workers, Lebanon is the caretaker of the fragile dreams of women from across Africa and Asia. In uprooting their lives and making the journey from countries such as Ethiopia, the Philippines and Sri Lanka to the southern shores of the Mediterranean, they hope to earn enough money to help ease the burden of poverty on their families back home.</div>

Not always, but all too often, they find themselves enduring a different kind of burden as victims of a system that facilitates exploitation and abuse.</div>

The<span class="Apple-converted-space"> </span><em>Kafala</em><span class="Apple-converted-space"> </span>system - which is also in place in a number of Gulf states - requires domestic migrant workers to have a sponsor in the country of their destination. This is usually the prospective employer, who has to pay visa and flight costs and possibly an agency fee. It is an outlay that runs beyond the thousand dollar mark, and which assistant coordinator of the Migrant Community Center in Beirut, Rahel Abebe, says leads to a misplaced sense of ownership.</div>

And that mindset leads to abuse which Human Rights Watch women’s researcher for the MENA region, Rothna Begum, says ranges from unpaid wages, confiscated passports, exhaustive working hours and no holiday or days off, to confinement, death threats, verbal, physical, and sexual abuse. And there is no legislation for them to turn to.</div>

"There are cases of women who end up risking their lives by climbing out of buildings in which they have been confined," Begum continued. Those who succeed are deemed to have absconded, a status that brings with it another set of problems. "In a system which is designed to make workers complete their contracts, they cannot just leave and find another employer."</div>

Although there are some small groups and NGOs on hand to help women who escape abusive employers, Ethiopian Rahel Abebe, herself a former domestic servant, says most workers are unaware of their existence. "If they run away, it takes them months to find an organization, so they live with friends or just somehow."</div>

Lina Khatib, Director of the Carnegie Middle East Center in Beirut, believes the basic problem in Lebanon is that migrant domestic workers are not regarded as equal human beings but as "second class entities" without full social and human and economic rights. And she attributes this to an inherent sense of racism and superiority toward domestic work that harks back to the days of feudalism and Ottoman rule.</div>

<br />الاسم ليس مهماً. «فيكم تسمّوني بارفين». هكذا بدأت السيدة البنغالية قصتها. وجدت «بارفين» نفسها في منزل عائلة لبنانية مؤلفة من سبعة أفراد. «كان يومي الأول كأنه في جهنم»، تقول السيدة الآتية من بنغلادش للعمل في المنازل لإعالة أولادها الأربعة بعد وفاة زوجها.<br />«لم تكن مشكلتي بكثرة الشغل، ولا بالساعات الطويلة، بل بطريقة تعاطي صاحبة العمل معي. لن أتحدث عن النوم على شرفة البيت والبرد القارس في بلدة جبلية مطلة على البحر»، قالت «بارفين».<br />اختارت أن تتحدث عن الجوع الذي عانت منه: «كانت مدام تعطيني 3 أوراق خس، وقطعة خبز عربي بحجم كفّ اليد».<br />وروت حادثة «قلي» السمك: «كان لون السمكات برتقالياً، وحجمها لا يتجاوز ثلاثة أصابع من يدي، كمشت معدتي ووجعتني وكنت ميتة من الجوع بس خفت أتذوق سمكة لأن المدام كانت تعرف عددهن».<br />كالعادة، منحت صاحبة العمل «بارفين» ثلاث أوراق خس مع خبزتها المعتادة، و«لكن كنت محظوظة أن أعطتني قطعة سمك». أكلت «بارفين» السمك «شوي شوي، ورحت طلبت خبزاً إضافياً حتى آكل قطعة السمك الصغيرة يلي بقيت معي». نظرت صاحبة العمل إلى «بارفين» وقالت لها «شو؟.. لا».<br />تصف العاملة البنغالية لياليها: «كنت نام عطول جوعانة». كنت أستيقظ في الصباح الباكر لأقطف حشائش الجنينة وأعطيها لصديقات المدام وأولادها. كنت أنظف أحياناً بيت ولدها المتزوج. في إحدى المرات عطفت علي زوجة ابنها ومنحتني صحناً كبيراً من الملوخية والأرز. «كنت كتير مبسوطة وأكلته كله». لكن فرحة «بارفين» لم تدم «عيّطت عليّ المدام واتهمتني بالكذب وأصرت أنني أنا التي طلبت الطعام من زوجة ابنها».<br />كانت تمضي وقتاً طويلاً في مساعدة صاحبة العمل على تحضير الحلويات، ولكن لا يُسمح لها بتناولها. أحياناً تسمح لها بتناول التالف منها، ولكن «بارفين» كانت ترميها في المهملات. بعد ثلاثة أشهر، خسرت ثلاثة كيلوغرامات من وزنها وجفت بشرتها وتشققت يداها: «ما طلبت من ألله إلا إنو يخليني موت».<br />بعد أربعة أشهر، لم تعد «بارفين» قادرة على التحمل: «طلبت منها تردّني ع المكتب». رفض أصحاب عملها طلبها وقالوا لها «لازم تدفعي 2500 دولار حتى نردّك»، وحبسوها على شرفة البيت من دون ماء لمدة ثلاثة أيام بعدما تمردت وتوقفت عن العمل. وبعد ذلك أرجعوها إلى المكتب. نسيت «بارفين» أن تخبر أن «المدام» لم تكن تسمح لها بالاستحمام سوى مرة في الأسبوع ومن دون «شامبو»، لأنه «ما في مَي كتير». كانت «تسرق» بعض دواء الجلي لتشعر بالنظافة.<br />استغلت صاحبة المكتب «بارفين» وقامت بتشغيلها في منزلها من دون مقابل، إلى أن وفقها الله «بعائلة جيدة وإنسانية». «لم يكن لديّ ملابس. أعطتني صاحبة عملي الجديدة ثياباً وألبسة داخلية وطلبت مني أن أستحمّ وأنام وأن لا أعمل في يومي الأول. قالت لي ارتاحي وبكرا منحكي». عندما تمدّدت «بارفين» على سريرها الجديد في غرفتها الخاصة في منزل صاحبة عملها الجديدة كانت تسأل نفسها «هالشي حقيقي؟ شكراً يا ألله.. أرجوك ما كون عم بحلم بس».<br />كان «مونو» هو المسرح، لكن الراويات لم يكنّ ممثلات. اعتلت خمس عاملات مهاجرات في لبنان خشبة مسرح «مونو»، أمس، ليحكين قصصاً حقيقية من سجل حافل بانتهاكات صغيرة وكبيرة، يمارسها بعض اللبنانيين بحقهنّ. القصص عينها وغيرها من شهادات نشرتها منظمة «كفى عنفاً واستغلالاً» في كتيب خاص حمل عنوان «لولا النظام»، في محاولة للإضاءة على الانتهاكات التي يسمح بها نظام الكفيل المطبق في لبنان. نظام الكفيل نفسه الذي يحول دون تمكن العاملات من تغيير أوضاعهن بسبب ربطهنّ بالكفيل وإرادته وإلا يصبحن «غير قانونيات».<br />ويأتي النشاط في إطار سلسلة من الأنشطة المستمرة اليوم وغداً لمناسبة عيد العمال. وترمي إلى «الوصول إلى اعتراف مجتمعي وقانوني بالعمل المنزلي كعمل حقيقي يستحق التقدير وحماية صاحباته والاحتفاء بهنّ في يومهنّ»، وفق مديرة قسم مكافحة الاتجار بالنساء في «كفى»، غادة جبور.<br />عدم تمكّن بعض العاملات من الحضور، كان جزءاً من المعاناة والانتهاكات. وعليه، قرأت «راحيل» (من إثيوبيا) قصّة صديقتها التي كتبت في رسالتها: «لمّا كانوا يقفلوا عليّ الباب كنت حسّ حالي بحبس.. كانت المدام تضربني بالنربيش، بس أنا ما كان هاممني حالي. كنت كل الوقت عم فكّر بإمي، وقدّيش عم تتعذّب من ورايي». هذه العاملة منعت لمدة عشرة أشهر من الاتصال بعائلتها، ومنعتها صاحبة عملها من الردّ على الهاتف عندما اتصلت والدتها من أثيوبيا وكذلك سفارة بلادها في لبنان.<br />أما الوجع الحقيقي لعاملة منزل فلا يشعر به وبقسوته سوى «عاملة المنزل نفسها، مهما بلغت درجة التعاطف والمناصرة». بهذه الطريقة عبرت رئيسة «الاتحاد الدولي لعاملات المنازل» ميرتل ويتبوي عن وجعها ووجع عاملات المنازل في العالم كله. قالت ويتبوي الآتية من جنوب أفريقيا، وبعدما بدأت حياتها كعاملة منزل في بلادها، إن القصص التي سمعتها في لبنان موجعة، وإنها تتشابه مع قصصها التي عاشتها ومع قصة كل عاملة منزل في أي مكان على الكرة الأرضية. وبعدما تحدثت عن انتهاكات تعرضت لها شخصياً كعاملة، شددت ويتبوي على أهمية أن تقود عاملات المنازل النضال بأنفسهنّ، ولكن أيضاً على تضافر الجهود بين العاملات والمجتمع المدني عموماً، والقضاة والإعلام أيضاً.<br />حضر إطلاق الكتيّب سفير بنغلادش في لبنان وممثلون عن عدد من السفارات الأجنبية في لبنان والقوى الأمنية، ومنظمات دولية وجمعيات أهلية وجامعات.<br />وقدّم المحامي رولان طوق، وهو من أوائل الذين دافعوا عن العاملات المهاجرات وساندهنّ في القضاء، مقارنة ما بين وضع العاملة المنزلية في ظل قانون العمل ونظام الكفيل. ودعا إلى إلغاء نظام الكفيل وضمّ العاملات إلى قانون العمل لوضع حدّ للانتهاكات التي تمارس بسبب نظام الكفيل. وفنّد الفروق بين النظامين، خصوصاً على صعيد آليّات الاستقدام وتكاليفها، وعقد العمل، وساعات العمل، والأجور، وأوقات الراحة والعطلة، والقدرة على التواصل مع العائلة والخارج.</div>

In any other context, this set of people would not be mingling in
Beirut: artists, academics, and domestic workers. On a recent evening,
all gathered at a community center to share research and experiences on
an issue–domestic workers’ rights–not otherwise addressed much in
Lebanese circles.<br />
“I want to try and help our sisters who don’t sleep, don’t eat, and
are afraid,” said Sujana Rana, a member of a Nepalese domestic workers
group. “We leave our homes, our families to come to Lebanon,” she said
with a quivering voice, “and work so hard to <br />
<a name='more'></a>earn a living.”<br />
Ms. Rana is one of about 200,000 migrant workers in Lebanon. Hired
household help is common across the Middle East. In places like Lebanon,
it’s inexpensive, so large communities of domestic workers from
Ethiopia, Nepal, the Philippines and other countries come to meet the
demand. They are part of the fabric of life here–but no legislation
protects their rights.<br />
Migrant domestic workers are excluded from the Lebanese labor law,
according to a 2013 report by Human Rights Watch. Their terms of
employment are defined in a specific relationship with their employer, a
system called “kafala” that is rife with profit-reaping and
exploitation. Agencies lure workers from their home countries with
promises of large salaries and a better life–a far cry from the working
conditions they usually face.<br />
Ethiopia and the Philippines even banned their citizens from working
in Lebanon. The Philippines overturned the ban in 2012 after signing an
agreement with Lebanon to regulate recruitment and employment.
Ethiopians still find ways to come here, despite their country’s
regulations.<br />
Their plight grabbed headlines in 2012 when an Ethiopian domestic
worker committed suicide at a psychiatric hospital. After that incident
brought public outcry, workers began to speak out across the country
about abuse by their employers.<br />
The Migrant Community Center in Beirut was set up three years ago as a
place where migrant workers and others in the community can learn about
the workers’ rights and how to protect them. “People come here for
help,” said Rana Boukarim, a program manager.<br />
Alicja Rogalska, an artist based in London and Warsaw, organized the
recent gathering at the center as part of a series of events that bring
together artists and academics on various social issues.<br />
Ms. Rana, the Nepalese worker whose group is supported by a local
NGO, said she visited the center to learn how to help others in her
community “who are suffering and who are scared to speak up.”<br />
“We want to help migrant workers,” she told a room of Lebanese
researchers, expats, and other migrant workers. “We are all human
beings.”</div>

An Ethiopian domestic worker died over the weekend in an apparent suicide in the southern city of Tyre, security sources told The Daily Star Sunday. <br /><br />The woman allegedly threw herself off a balcony of the apartment building where she worked, the sources said. <br /><br />Media reports said the woman had fled last week from her employer’s home. Security forces later detained the Ethiopian and returned her to her employer.<br /><br />

E., 33, regarding a rape offense,” the ISF's public relations department said in a statement.<br /><br />“Following intensive investigations, it turned out that the aforementioned worker had headed along with her employer to an agency for the recruitment of migrant domestic workers in the Koura town of Kousba after a dispute erupted between them,” the statement added.<br /><br />Further investigations showed that the agency's female secretary L. S., 24, had called agency employee A. Z., 40, and asked him to come to office to resolve the dispute between the domestic worker and her employer, according to the statement.<br /><br />“Upon his arrival, he beat up the worker with the aim of 'disciplining her' before forcing her to take off her clothes under the excuse of searching her. He then raped her after assaulting her with his belt, within earshot of the secretary who was in the adjacent room,” the ISF said.<br /><br />It added that the man threatened the maid not to tell her employer about what happened inside the office and that following medical examinations, a forensic doctor confirmed the presence of bruises on “sensitive spots” of the domestic worker's body.<br /><br />Police also verified that distinguishing marks mentioned by the maid were found on the assaulter's body.<br /><br />“A. Z. and the secretary L. S. have been arrested following authorization from the relevant judicial authorities,” the ISF added.</div>

حماية من العاملات الأجنبيات». والعنوان ليس مزحة، وإن كان سمجاً ومنفراً
للغاية. مساواة الجلاد بالضحية، في لحظة ضعف الأخيرة. هذه هي الفكرة التي
تقوم العنصريّة على أساسها. الجلاد يعتقد أنه ضحية، وأن العنصريّة هي لحظة
الثأر المفترضة والأبديّة. مساواة الجلاد بالضحية ليست فعلاً عنصرياً بحد
ذاتها، إنها الحجر الأساس.

اسمعوا جيداً ما تقوله جودي الأسمر، في «البيان»: «الكثير من الأسر ذات
الصيت الحسن والسيرة الجميلة، التي يشهد لها الجميع عانت مع العاملات
الأجنبيات اللواتي بادلْنها المعاملة الجيدة بالإجرام أو السرقة، أو تنفيس
عقدهنّ النفسية». الأسر ذات الصيت الحسن والسيرة الجميلة، والحق أنه لا أحد
يمكنه أن يفهم كيف يمكن أن تكون سيرة الأسرة جميلة، إلا تلك النوعية من
المحافظين التي تنبذ الفئات الاجتماعيّة وتضعها في خانة «أقل». فسّرت
الأسمر «القطبة المخفيّة» في الموضوع. وضعت إصبعها على الجرح تماماً:
«عقدهن النفسيّة». وإن كان بالإمكان تفسير الرخام، فإن تفسير هذه الكراهية
قد يكون ممكناً. إن كان تفكيك الجبال إلى بحص ممكناً، فإن تبرئة الكاتبة من
العدائية قد يكون ممكناً أيضاً. طبعاً، لم تجر دراسةً، ولم توضح كيف تكون
«العقدة النفسيّة»، وهذا ينسحب بدوره على علاقة اللبنانيين السطحية مع الطب
نفسي، وسوء فهمهم له. اللافت أن النص ذاته يشير إلى انتحار عاملة كل
أسبوع، وإلى وفاة وضرب الكثير من العاملات «المعقدات نفسياً»، وفقاً للنص.
وللأمانة، هذا ليس نقداً، بل دعوة إليهن للمواجهة. يوماً بعد يوم، يتضح أن
البلاد تعج بالمعقدين نفسياً. وغالب الظن أن الوصف هنا في مكانه، طالما
أننا نتحدث عن كراهية لا ترتكز إلا إلى بعض الحالات التي أظهر القضاء
اللبناني، بعد تحقيقات خجولة العدد، أن الحق كان مع العاملات في كثير من
القضايا.<br />
وإذ كانت «البيان» تقريباً مغمورة، فكيف تكون الحال عندما تنشر صحيفة
«عريقة»، كالـ«نهار» مقالاً يحرّض على العاملات الأجنبيات. يصير تفكيك
البنيّة العنصريّة لفئات واسعة من الشعب اللبناني أمراً سهلاً. تسأل
الصحافية ليال كيوان، ببراءة طبعاً: « وهل فعلاً معاملتهن سيئة الى الحد
الذي يجري تصويره؟». تضعنا الزميلة كيوان في موقع حرج هنا. تجبرنا على أن
نسأل عن أنفسنا: ألا تقرأ الصحف؟ ألا تشاهد التلفزيون؟ ألم تسمع بمؤسسة
اسمها «هيومن رايتس واتش»، أو «قوى الأمن الداخلي»؟ هذه مصادر، تقريباً
مجانيّة للصحافيين، وهي متاحة للجميع. لقد وصل معدل انتحار العاملات في
لبنان، إلى واحدة كل أسبوع. برأي الزميلة كيوان، على ما يبدو، هذا ليس
كافياً. يجب أن يَنتحرن أو يُنتحرن جميعاً، لكي تطمئن إلى أن الظلم الذي
تتعرض له العاملات حقيقي، لا رغبة من أحد في «تشويه صورة لبنان»، كما حذرت
في سؤال عبقري آخر. وهذا سؤال آخر، إن كان يبعث على شيء، فإنما يبعث على
السأم من كل هذه الشعارات الشوفينية، التي أكل الزمن عليها وبصق. الكارثة
الكبرى أن العاملات ضحية نظام بطريركي، ما انفك يفتك بالجميع، ويتنامى ويجد
دائماً من يصفق لهذا التنامي من بين ضحاياه. للأمانة، أدت كيوان شيئاً من
واجباتها الصحافية، وأخذت رأي «الناشطة في حقوق الإنسان»، غادة الريس. لا
نعرف طبيعة الأسئلة التي وجهت إلى الريس، أو إن كانت الكاتبة قد اجتهدت في
الاقتباس أيضاً، لكن ما قرأناه يقول إن الريس «وضعت تصرفات العاملات
الأجنبيات مقابل تصرفات أرباب العمل، وأشارت إلى أن العاملات أيضاً، وفي
حالات كثيرة، يأتين بأعمال منافية للأصول مع مستخدميهن.».<br />
وإذا كان هذا صحيحاً، فإنه يسقط عنها صفة «الناشطة»، ويتيح لنا استبدال صفة «حقوق الإنسان» من التعريف عنها، إلى «حقوق أرباب العمل».<br />
والحق أن الإسرائيليين يقولون الكلام نفسه حين يقتلون الأطفال في غزة.
الأطفال يرشقون الدبابات بالحجارة. والحق أن الأنظمة قالت إن شعوبها
إرهابية عندما خرجت عارية تطالب بالحريّة. والحق أيضاً، أن الفاشيين قالوا
إن أعداءهم يخططون لقتلهم دائماً. وكان يتبين العكس دائماً.<br />
«العكس» واضح في حالة العاملات الأجنبيات، ولا يحتاج إلى تفسير. نتحدث عن
نظام «الكفيل» المذل. عن عشرات حالات التحرش والاغتصاب، التي لا تقيم لها
الزميلتان جودي وليال أي وزن. نتحدث عن انتحار العاملات. لمعلومات الزميلة
في «النهار»: لبنان جحيم، ويمكن وضع فئات كبيرة من شعبه في خانة العنصريّة،
دون أي التباس. وما مقالها «المتخاطر» مع مقال الأسمر إلا دليل قاطع على
ذلك.</div>

Nazmi Boghom, a 31-year old who works for Robert Hajj at his home in the southern border town of Rmeish, crossed the barbed wires on the border into the occupied territories in Palestine.<br />
<br />
Patrols from the Lebanese Army and United Nations Interim Forces in Lebanon immediately arrived to check the incident while an Israeli patrol on the other side of the border was on alert.<br />
<br />
Contacts are ongoing to return the Bangladeshi worker into Lebanon. The security forces also launched an investigation with Hajj over the reasons that prompted the domestic worker to escape.</div>

<a href="http://www.al-akhbar.com/node/195095">جريدة الأخبار، العدد ٢١٥٣ السبت ١٦ تشرين الثاني ٢٠١٣، راجانا حمية</a><br />أصدرت القاضية المنفردة الجزائية في كسروان، دينا دعبول، حكمها في قضية العاملة المنزلية، الفيليبينية، انالي بورتوغال. أنصفتها، ولو متأخرة، وفعلت «ما يملي عليه ضميرها الإنساني»، بحسب ما قالت ليلى عواضة، المحامية في منظمة كفى عنف واستغلال. أكثر من ذلك، انتصرت لها عندما فكّكت تلك الصورة النمطية التي استسهلت ترحيل العاملة وغسل «ذنوب» الكفيلة، بمجرد صك إبراء لذمتها من أية حقوق مالية متوجبة عليها للعاملة.<br />هذه المرة، لم يمرّر القضاء القضية على هذا النمط. لم يترك قروح جسدها التي تسببت بها كفيلتها على مدى أشهر خدمتها بلا تعويض «عطل وضرر».<br />القاضية دعبول حكمت على صاحبة العمل وفاء م. المدعى عليها بشكوى قدمتها السفارة الفيليبنية أمام النيابة العامة الاستئنافية في جبل لبنان في نيسان من العام 2008 ـ بالحبس 3 أشهر وبغرامة 100 ألف ليرة لبنانية سنداً لأحكام المادة 555 من قانون العقوبات، وإلزامها بدفع تعويض الى المدعية الشخصية انالي بورتوغال قدره 10 ملايين ليرة لبنانية وبتدريكها النفقات القانونية.<br />بورتوغال، هي الشابة التي انفلش عنف صاحبة عملها «على مساحة 70% من كامل مساحة الجسم»، بحسب التقرير الذي وضعه الدكتور كيفورك جيان، المحلف لدى المحاكم في السادس والعشرين من نيسان العام 2008. اشار التقرير الى «أنها كانت تتعرض الى ايذاء جسدي متكرر وأنواع مختلفة من إصابات حارة او جراحية او كدمية وبمختلف الالات كآلة قبضة اليد والأصابع والمكواة والاحذية والمشايات والحزام مثلا (…)».<br />هذا الحكم هو الثاني من نوعه، بعد حكم أول صدر في تموز الماضي لصالح عاملة منزلية وقضى بحبس صاحبة عملها بسبب رفض سداد رواتبها. لكن، في كلا الحكمين حضرت العدالة متأخرة. في الحكم الأول، أتى بعد 3 سنوات وفي الثاني بعد خمس سنوات. تلك الفترة الطويلة تخفف من قيمة العدل الذي تحقق.<br />بورتوغال قد لا تكون علمت أنها انتصرت. ونحن، لا نعرف أين هي الآن؟ وكيف تعافت من العنف الذي لحق بها؟ وماذا سيفعل لها الانتصار بعد كل هذا الوقت والأذى؟ وعما إذا كانت المدعى عليها ستنفذ الحكم أم أن الأمور ستسير على الطريقة اللبنانية؟ كل هذه الأسئلة تحتاج إلى أجوبة صريحة.<br />القاضية دعبول، بحسب المحامية عواضة، «أفسحت المجال أمام المدعى عليها كي تدافع عن نفسها، وخصوصاً عندما شككت الأخيرة في صحة تقرير الطبيب الشرعي. لكنها اكتفت بالقول ان المدعية تكذب»، هذا ما ورد في نص الحكم. وتقول عواضة ان المدعى عليها لم تتقدم بالطعن و«لم تكن القاضية لتنصاع لما تقوله».</div>

Davhin was working as a domestic worker at the Dadi residence, the sources said.<br /><br />It is likely she committed suicide, the security sources added. An investigation into the incident is under way.</div>

وتعزيزها ، أُطلقت مدوّنة قواعد السلوك التي تتضمن المبادئ التوجيهية
لوكالات التوظيف حول تعزيز حقوق الخدم من المهاجرين وحمايها وذلك في شهر
حزيران / يونيو في لبنان. تلتزم كافة وكالات التوظيف بموجب هذه القواعد
حماية عمالها من كافة اشكال التمييز والانتهاك الجسدي والجنسي وغيرها من
أشكال الاستغلال. يتوجب على هذه الوكالات توضيح حقوق العمال والعمالة ،
والوظائف المتوقعة في بداية العقد المبرم. ويتعين عليها تعريف العمال
وارباب العمل على حقوق وواجبات كل منهم والتواصل معهم بلغة يفهمها العامل.
وسيجري إدراج الوكالات التي تنتهك مدونة قواعد السلوك بتسهيلها الكفالات
مما يؤدي إلى السخرة والاستغلال على سبيل المثال على القائمة السوداء .
تتناول بعض المبادئ الواردة في مدونة قواعد السلوك من بين أمور أخرى،
ممارسة الشفافية في الأعمال التجارية ، وتوفير المعلومات الكاملة للعامل
حول شروط العمل في لبنان ، والتحقق من مؤهلات العامل وعدم كفالة العمال ممن
هم دون السن القانونية. <br /><br />
خلال مؤتمر صحافي بمناسبة إطلاق المدونة ، أبرز نضال الجردي الخبير في حقوق
الانسان لدى مكتب المفوضية السامية لحقوق الانسان أهمية آلية التنفيذ
والمساءلة الذتية ذات الصلة والاجراءات التأديبية. وقال مضيفا " إنه وفي ظل
غياب أي إطار تنظيمي وقائي محصن من قبل الدولة لخدم المنازل ، فإن مدونة
قواعد السلوك تُعد الوثيقة الوحيدة المتاحة حتى الآن القادرة على تعزيز
الشفافية وعملية الكفالة لخدم المنازل من المهاجرين " . </div>

29 July 2013 - In Lebanon, people working in private households are excluded from the protection of labor law.<br /><br />[A domestic worker in Lebanon holds up a copy of her paper © Simba Russeau/IRIN] More than 200,000 migrant workers, mainly women, work in Lebanese households. Although they constitute a large proportion of the workforce, they do not enjoy the same rights as, for example, local shop assistants or factory workers.<br /><br />A Code of Conduct, launched in June 2013, now provides guidance to recruiting agencies on promoting and protecting the rights of migrant domestic workers in the country.<br /><br />Developed in consultation with the Middle East Office of the High Commissioner for Human Rights (OHCHR) and the International Labor Organization (ILO), the Code of Conduct was jointly put together by the Lebanese Ministry of Labor, the Syndicate of Owners of Recruitment Agencies in Lebanon (SORAL) and Caritas Lebanon's Migrant Center.<br /><br />"This Code of Conduct is the result of two-years efforts<a name='more'></a> to find a common ground between protecting the community's weakest links, migrant domestic workers, and safeguarding the interest of recruitment agencies," said OHCHR human rights expert Nidal Jurdi during a recent press conference, announcing the launch of the Code of Conduct.<br /><br />Funded by the European Union and the Swiss Agency for Development and Cooperation, the 55-page booklet is part of OHCHR and ILO's ongoing efforts to protect and promote the rights of domestic workers in Lebanon. Under the Code, all recruitment agencies are obligated to protect their workers from all forms of discrimination, physical and sexual abuse and other forms of exploitation. The agencies are duty-bound to clarify worker and employment rights, and expected functions at the very beginning of the contract relationship. They introduce workers and employers to their rights and obligations and communicate in a language that is understood by the worker. Those agencies that violate the code of conduct by facilitating work placements leading to forced labor and exploitation for instance, will be blacklisted.<br /><br />Some of the principles upheld in the Code of Conduct include, among others, transparency in business operations; the provision of full information to the worker about conditions of employment in Lebanon; the verification of the worker’s qualification and no placement of underage workers.<br /><br />"The challenge remains in the implementation mechanism and in relevant self-accountability and disciplinary actions," said Jurdi, adding that “in the unfortunate absence of a labor law that protects the rights of migrant domestic workers, this booklet is definitely a step forward in the right direction, within the frame of an international commitment towards which the Lebanese Government is answerable." “In the absence of any state-manned protective regulatory framework for domestic workers the Code of Conduct is the sole available document so far capable of enhancing the transparency of the placement process of migrant domestic workers,” he added.<br /><br />"The Code of Conduct is not enough by itself," Jurdi said. He stressed that ultimately, the State was the main "duty-bearer" concerning migrant domestic worker rights, as the Code does not replace the importance of having strong legislation.<br /><br />Since 2005, OHCHR has been working closely with the Lebanese Government, ILO and various non-governmental organizations to alleviate the hardship of domestic workers in Lebanon. A Steering Committee was set up in the same year to develop a national plan of action. One of the first major achievements of the Committee was the drafting of a unified contract, which provided a common set of standards to protect domestic migrant workers. <a href="http://www.al-akhbar.com/node/188458">جريدة الأخبار، زينب مرعي، العدد ٢٠٧٤ الأربعاء ٧ اب ٢٠١٣</a><br /><br />هو حكم نوعي يُحتذى به. هكذا وصفت منظمة «كفى عنف واستغلال» الحكم الذي صدر عن القاضي المنفرد الجزائي في بعبدا نادر منصور لصالح العاملة المنزليّة و. س. من التابعية السيريلنكية. إذ في تاريخ 10/7/2013 حكم منصور بحبس المدّعى عليها و. ق. (اللّبنانية) مدّة شهرين وبغرامة خمسمئة ألف ليرة لبنانية، وبإلزامها بأن تردّ للمدّعِية، أي العاملة المنزلية التي توكّلت عنها منظمة «كفى عنف واستغلال»، مبلغ 3750 دولاراً، بالإضافة إلى عطل وضرر بقيمة مليون وخمسمئة ألف ليرة لبنانية! ما هي القصّة التي أدت إلى هذه النهاية السعيدة للمرة الأولى؟<br />خدمت العاملة المنزلية و. س. في منزل السيدة و. .ق مدّة ثلاث سنوات، من دون أن تدفع لها السيدة قرشاً واحداً مقابل عملها طيلة تلك الفترة. في الفترة الأولى، كانت السيدة تبرّر للعاملة عدم دفعها لها راتبها، بكونها تدّخر لها أموالها إلى حين سفرها! لكن بعد فترة من الزمن، لم يعد بمقدور العاملة احتمال الموضوع، فما كان منها إلا أن هربت من المنزل قاصدةً السفارة السيريلنكيّة لإيجاد الحلّ. حاولت السفارة التفاوض مع سيدة المنزل، فتعهّدت هذه الأخيرة بدفع مستحقّات العاملة كاملة إذا ما عادت إلى العمل لديها. على أثرها، عادت و. س. إلى منزل و. ق. لتزاول عملها من جديد. لكن سيدة المنزل لم تدفع لها مستحقاتها القديمة أو الجديدة. وعود السيدة المتجدّدة وحاجة العاملة إلى راتبها جعلت الأمر يطول ثلاث سنوات. لكن في منتصف العام 2010، لم تعد و. س. قادرة على احتمال العمل بالسخرة الذي تجبرها عليه سيدة المنزل، فما كان منها إلا أن هربت مرّة ثانية، قاصدة السفارة من جديد. تواصلت عندها السفارة مع «كفى» لتجد حلاً لمشكلة العاملة، فحاولت حينها محامية المنظّمة موهانا اسحق التفاوض مع و. ق. من أجل حلّ الموضوع بأفضل السبل، لكنّ السيّدة أصرّت على رفضها دفع راتب العاملة، حتى انتقلت القضيّة إلى المحكمة. لم يكن بمقدور العاملة الانتظار حتى صدور الحكم في القضية التي علمت أنه سيطول البحث فيها، فعادت إلى بلادها خالية اليدين بعد ثلاث سنوات من العمل. لكن القاضي منصور حكم أخيراً لصالح العاملة. تشير اسحق الى أنّها «قد تكون المرّة الأولى التي يصدر فيها حكم من هذا النوع، إذ تدخل مواضيع الأجور عادة ضمن نطاق النزاعات المدنيّة. لكننا تقدّمنا بدعوى جزائيّة بما أننا اعتبرنا أنّ احتفاظ سيّدة المنزل بأجر العاملة وعدم إعطائها إياه هو إساءة للأمانة. وأرسلنا لها إنذاراً على هذا الأساس». تضيف اسحق إنّ الجديد في الموضوع أنّ القاضي لم يردّ الدعوى إلى المحكمة المدنيّة على أساس أنّها قضيّة أجور بل في «اجتهاد نوعي»، اعتبر القاضي أنّ فعل المدّعَى عليها لجهة احتفاظها لنفسها بمجموع الأجور المستحقّة للمدّعِية عن فترة عملها لديها، إنّما يشكّل جرم إساءة أمانة سنداً للمادّة 671 عقوبات، الأمر الذي رأت فيه المنظّمة ضمانة أكبر وحماية أفضل لهذه الفئة المستضعفة من العمّال وهو يشكّل رادعاً قوياً لمثل تلك المخالفات السائدة في لبنان. قد يكون باستطاعتنا الآن، بعد صدور الحكم غيابياً على السيدة و. ق. أن نكتشف عنوانها الجديد، حين تتبلّغ الحكم الصادر بحقّها، بما أنّها عمدت إلى تغيير رقم هاتفها وعنوان منزلها بعد تفاعل القضيّة وتقديم الشكوى بحقّها نهاية العام 2010، فتعذّر تواصل المنظّمة معها منذ ذلك الوقت.</div>

<em>في إطار مرصد قضايا عاملات المنازل
أمام القضاء الذي أطلقته المفكرة القانونية بالتعاون مع منظمة العمل
الدولية وبدعم مالي من الاتحاد الأوروبي وتبعا لبحثها الأول المنشور في
العدد السابق حول قضايا هذه العاملات أمام مجالس العمل التحكيمية، تنشر
المفكرة في هذا العدد مقالا عن كيفية مقاربة القضاء لواقعة ترك العمل من
قبلهن والتي غالبا ما تسمى "بالفرار"، بما يعكس رواسب العبودية. وينشر هذا
المقال على وقع أنباء بمقتل عاملة منزل في منطقة بعبدا فيما كانت تحاول
"الفرار" من المنزل الذي كانت تعمل فيه (المحرر). </em><br /><br />
<strong>عيّنة الأحكام موضوع المقال </strong><br /><br />
حصيلة الأحكام الجزائية التي جمعناها منذ بدء عمل المرصد هي 210أحكام
جزائية صادرة بين شهري كانون الثاني وحزيرانمن العام 2013، وهي تنقسم على
الشكل الآتي: 84 حكما صادرا في محافظة بيروت في قضايا مرفوعة من قبل الحق
العام دون ادعاء شخصي، و37 حكما صادرا في بعبدا (حق عام وشخصي)، و89 حكما
صادرا في جديدةالمتن (حق عام وشخصي). وبالطبع، لحاجات هذا المقال، تعين
علينا منذ البدء أن نصطفي منها الأحكام التي تتصل بحالات الترك مباشرة، أي
بالحالات التي تمت فيها ملاحقة عاملات المنزل على خلفية ترك عملهن في منزل
صاحب العمل. وفيما 94<span dir="LTR">%</span>من هذه الأحكام (198 حكما)
تناولت ملاحقات متصلة بشروط إقامة الأجانب في لبنان وأن 186 حكما منها
تناولت حصرا هذا النوع من الملاحقات، فإن عدد الأحكام التي تناولت مباشرة
"ترك منزل صاحب العمل" في حيثياتها ينخفض عند التدقيق فيها الى 62 حكما وهي
الأحكام التي سنحصر دراستنا أدناه فيها. أما سائر الأحكام الصادرة في
جرائم مخالفة أحكام الإقامة والتي لم تذكر صراحة الترك، فيرجح أن تكون صدرت
في حالات تقاعس فيها أصحاب العمل أنفسهم عن تجديد أوراقها أو في حالات
كانت فيها العاملة قد تركت العمل، فباتت منذ سنوات كثيرة في وضع غير مشروع
أو ربما أيضا في حالات ترك لم تشر اليها الأحكام صراحة.<br /><br />
<strong><em>الفرار والهروب، مرادفات قضائية من رواسب العبودية </em></strong><br /><br />
ومن أبرز مايلفت في العينة المشار اليها أعلاه، هو أن 7 من أصل 11 قاضيا
ممن دُرست أحكامهم، استخدموا عبارة "الفرار" أو مرادفها "الهروب" للدلالة
على ترك العاملة في الخدمة المنزلية مكان عملها، وقد تم استخدامها ليس فقط
في سرد الوقائع، إنما أيضا في باب القانون، رغم أننا لا نجد لهذه العبارة
أي محل في النصوص القانونية التي تشكل إسنادا للادعاء أو للحكم كما سنبين
أدناه. وهكذا، وردت عبارة الفرار (أو الهروب) كما سبق ذكره في 62 حكما، وقد
وردت في بابي الوقائع والقانون في 47 حكما، فيما وردت فقط ضمن الوقائع في
12 حكما. والواقع أن "الفرار" عبارة تستخدم في القانون للدلالة على من فر
من السجن أو من فر من وجه العدالة، وذلك في أطر تتعلق بالحرمان من الحرية
الحاصل وفق القانون، أما أن يتم استخدامها للدلالة على مغادرة عامل لمكان
عمله، فهذا يدل على مدى قوة الأفكار المسبقة المتمثلة بشيوع الصورة النمطية
الدونية للعاملات في الخدمة المنزلية، اللواتي يُعددْن بمثابة أشياء تعود
ملكيتها لصاحب العمل طوال مدة العقد أو بمثابة رهائن لديه له أن يستبقيهن
حتى استهلاك استثماره المتمثل في نفقات استقدامهن. وبالطبع، يؤشر هذا
الموقف الى ربط ضمني بين وضع عاملات المنازل ووضع الرقيق الذين كانوا
يعاقبون على خلفية فرارهم من منازل مالكيهم، وتاليا يمكن اعتبار هذا الوضع
كأحد رواسب زمن العبودية.<br /><br />
وللأمانة، نسجل من خلال الاطلاع على عدد من الأحكام من خارج هذه العينة أن
عددا من القضاة يرفضون استخدام هذه العبارة بما تحمله من معان<a href="http://legal-agenda.com/print.php?id=465&folder=articles&lang=ar#_ftn1" name="_ftnref1" title=""><sup class="tiny">[1]</sup></a>.<br /><br />
<strong><em>الأسناد القانونية لمعاقبة ترك المنزل (الفرار)</em></strong><br /><br />
ومن بين المواد التي تستند اليها الأحكام لمعاقبة ترك العمل أساساً المواد 15 و21 من المرسوم 17561/1964<a href="http://legal-agenda.com/print.php?id=465&folder=articles&lang=ar#_ftn2" name="_ftnref2" title=""><sup class="tiny">[2]</sup></a>
وبعضها مقترنة مع مواد أخرى كالمادة 7 من القرار 136 أو المادة 36 من
قانون العام 1962 أو المادة 636 عقوبات وهي تشكل نسبة 35%. والمادتان 15
و21 من المرسوم المذكور تفرض على كل أجنبي حائز إجازة عمل أو موافقة مسبقة،
أن يحصل على موافقة وزارة العمل المسبقة إذا أراد أن يغير نوع عمله أو
المؤسسة التي يعمل فيها. وبناء على هذه المواد، خلص عدد من الأحكام الى
القول بأن إقامة العاملة التي تركت عملها من دون مراعاتها تصبح تلقائيا في
وضع غير شرعي. وبالطبع، نجد هنا أحد أهم انعكاسات نظام الكفالة المتمثلة في
ربط شرعية الإقامة بعقد العمل، بحيث تنتهي صلاحية الإقامة فور انتهاء
العقد، مهما كانت أسبابه. وما يعزز نظام الكفالة ويوسع مداه، هو العرف
المتبع لدى وزارة العمل بعدم إعطاء الموافقة المسبقة بتغيير صاحب العمل إلا
بعد الحصول على موافقة الكفيل الذي تركت "خدمته". وبالتالي يصبح وجود
العاملة غير شرعي في البلاد وتتعرض للمعاقبة بعدم تجديد الإقامة (المادة 36
من قانون تنظيم الدخول الى لبنان والإقامة فيه والخروج منه) إضافة الى
إمكان معاقبتها بـ"الفرار" من العمل.<br /><br />
واللافت في هذا المجال أنه تم تطبيق هذه المادة في حالات لم يثبت فيها أي
دليل على قيام العاملة بأي عمل جديد، أي في حالات تركت فيها العاملة عملها
السابق من دون أن يثبت بحال من الأحوال أنها باشرت عملا جديدا. وهذا ما
نقرأه بوضوح كلي في الحكم الصادر عن القاضي المنفرد الجزائي في جديدة المتن
في 26/3/2013، في قضية "هرب" عاملة من مكان عملها والتجائها الى منزل تعمل
فيه إحدى قريباتها، حيث عمد رب عمل هذه الأخيرة الى الاتصال بصاحب مكتب
الاستقدام وبتوصيلها اليه. وبعد أن أعلم هذا الأخير صاحبة العمل بوجودها
لديه، وعمدت دورية من الأمن الداخلي الى "استلامها" منه، أدينت على أساس
المادة 15 من المرسوم 17561/1964 المشار اليها أعلاه، وقد علل القاضي
إدانتها بالشكل الآتي "حيث يتبين من الوقائع والأدلة أن المدعى عليها وبعد
دخولها الأراضي اللبنانية بصورة شرعية أقدمت على الهرب من منزل مخدومتها من
دون إبلاغ المراجع الرسمية المختصة، وحيث إن فعل المدعى عليها هذا يشكل
الجنحة المنصوص عنها في المادة 15 و21 من المرسوم 17651/64 ويقتضي إدانتها
بأحكامها".<br /><br />
والى ذلك، انتهج عدد من القضاة منحى مختلفا بحيث رفضوا تطبيق المادة 15
المشار اليها أعلاه على الترك في القضايا المعروضة عليهم (حوالي 28%)،
وبعضهم كما صرح لنا في مسعى للابتعاد عن نظام الكفالة. فالترك لا يشكل بحد
ذاته جرما، عملا بمبدأ حرية الشخص في ترك عمله، انما يؤدي الترك الى عقوبة
وفق هؤلاء القضاة إذا خالفت العاملة أحكام المادة 7 من القرار 136/1969،
الذي ينظم مسألة إثبات وجود الأجانب في لبنان، والذي يفرض على كل أجنبي
يحمل بطاقة إقامة سنوية ويقيم في لبنان لمدة تفوق ثلاثة أسابيع أن يتقدم
خلال الأسبوع الذي يلي انقضاء هذه المدة الى مديرية الأمن العام التابع له
محل إقامته بغية الحصول على بطاقة إثبات وجود له. وبذلك، وبخلاف ما يفرضه
التوجه القضائي الأكثر شيوعا بالاستناد الى المادة 15 والمشار اليه أعلاه،
يكون للعاملة الراغبة بترك عملها أن تتحرر وفق هذا التوجه الأخير من
الملاحقة الجزائية من خلال تبليغ المديرية العامة للأمن العام مقامها
الجديد فقط، من دون الحاجة الى الحصول على موافقة مسبقة من وزارة العمل أو
من صاحب العمل، الأمر الذي يسمح مبدئيا بفك الرابط بين عقد العمل وشرعية
الإقامة. ومن الأمثلة على هذا التوجه، نذكر الحكم الصادر عن القاضي المنفرد
الجزائي في بيروت، بتاريخ 31/1/2012، حيث اعتبر أن العاملة المدعى عليها
قد تركت العمل خلسة، ولم تبلّغ "القوى الأمنية عن محل إقامتها الجديد..".<br /><br />
إلا أنه بالرغم من هذا الاختلاف الهام على الصعيد المبدئي، يبقى أن
المقاربتين تؤديان عمليا الى نتائج متشابهة تتمثل في معاقبة العاملة على
عدم إعلام السلطات بتغيير مكان إقامتهاما دام يندر جدا أن تقوم عاملة
بإبلاغ السلطات بمكان إقامتها (وهو أمر لا يحدث إلا في حال لجوئها الى
السفارة) وذلك إما لجهلها الكامل لهذا الموجب أو لخوفها الشديد من توقيفها
ومحاكمتها بجرم الفرار وفق ما بات شائعا ومعلوما. كما يلحظ أن بعض القضاة
الذين اعتمدوا هذا التوجه لم يجدوا أي حرج في استخدام عبارة "فرار" فوردت
في 19 حكما (أي 28%) صادرا استنادا الى هذا التوجه، ما يعكس اشتراكهم في
النظرة الدونية لأشخاص العاملات. كما يلحظ أن العقوبة المفروضة بموجب هذا
التوجه كانت عموما معادلة من حيث قسوتها للأحكام المبنية على المادة 15
أعلاه وفق ما نعرضه في مقال منفصل. ويكفي في هذا المجال أن نشير الى أن
عقوبة الحبس المحكوم بها في هذه الحالات تراوحت ما بين 15 يوماً وشهرين،
فيما تراوحت الغرامة المحكوم بها بين 50.000 و600,000 ليرة لبنانية، علما
أنه يتعين حبس العاملة يوما واحدا عن كل عشرة آلاف في حال عدم الدفع وذلك
سندا للمادة 54 عقوبات.<br /><br />
<strong>سرقة وفرار </strong><br /><br />
أبرز ما يظهر في الأحكام الصادرة في القضايا التي تم تحريكها بادعاء شخصي،
هو الربط بين الادعاء بالفرار والادعاء بالسرقة الذي يظهر وكأنه بات ملازما
للأول. وضمن عينة الأحكام، نجد 11 قضية تم تحريكها بناء على شكوى مباشرة،
10 منها اشتملت على جرمي السرقة و"الفرار". وإذ يعكس هذا التلازم إرادة
صاحب العمل في تضخيم خسارته الناجمة عن فرار العاملة من منزله، فإن له أيضا
أسبابا إجرائية وفق ما أشار اليه عدد من القضاة وعناصر من قوى الأمن
الداخلي الذين أشاروا الى أن المخافر لا تقوم بفتح محضر إذا تركت عاملة
الخدمة المنزلية مكان عملها إلا في حال السرقة، فيما يطلبون من الكفيل خارج
هذه الحالة التوجه الى النيابة العامة لتقديم شكوى.<br /><br />
ونسجل أن 3 من هذه الأحكام انتهت الى تبرئة العاملة من جرم السرقة، فيما من
بين الـ7 المتبقية والتي انتهت الى أحكام بإدانتها بهذا الجرم، صدرت 5
منها بالصورة الغيابية فاتحة الباب أمام اعتراض العاملات في حال القبض
عليهن. تجدر الإشارة خاصة في هذا المجال الى حيثية أحد هذه الأحكام المعبرة
ومفادها: "حيث إن فعل المدعى عليها لجهة إقدامها على الفرار من منزل
مخدومها الى جهة مجهولة دون إعلام السلطات المختصة ضمن مهلة أسبوع يؤلف
جنحة المادة 7 من القرار 136 والمادة 636 عقوبات". هكذا، من دون أي إثبات
على حصول السرقة، وعلى نحو يؤشر الى تلازم ما بينها وبين الفرار ليس فقط
لدى أصحاب العمل إنما في ذهن بعض القضاة أيضا.<br /><br />
إلا أنه بالمقابل، تم رصد عدد من الأحكام من خارج هذه العينة أظهرت سعي بعض
القضاة الى كبح هذه الممارسة بربط المسألتين. ومن هذه الأحكام مثلا، الحكم
الصادر عن القاضي المنفرد الجزائي في طرابلس، في 29/11/2012، تبعا لادعاء
قدمته صاحبة عمل ضد عاملة لديها بجرم السرقة بعدما كانت تركت منزلها.
وبعدما بين الحكم أن المدعية أقرت أنها تقدمت بدعواها ضد العاملة ليس بسبب
السرقة، إنما لأنها تركت المنزل بسبب كثرة العمل، وأنها أسقطت الدعوى عنها
بعدما عادت العاملة للعمل في منزلها، لم يكتف بتبرئة العاملة من جرم السرقة
لعدم كفاية الدليل إنما أحال القضية أمام "النيابة العامة الاستئنافية في
الشمال من أجل اتخاذ الموقف الذي تراه مناسبا بشأن الادعاء بحق المدعية
المسقطة بجرم الافتراء". وقد ذهب القاضي نفسه أبعد من ذلك في قضية أخرى:
فبعدما تثبت أن العاملة غادرت المنزل بسبب تعرضها للضرب وإساءة المعاملة من
قبل صاحبة العمل، أعلن براءتها من جرم السرقة محيلا "الأوراق لجانب
النيابة العامة الاستئنافية في الشمال من أجل اتخاذ الموقف الذي تراه
مناسبا بشأن الادعاء بحق المدعية (...) بجرم الضرب والإيذاء".<br /><br />
ورغم صدور عدد هام من الأحكام المماثلة عن جهات قضائية عدة بالبراءة،
وأحيانا باعتراف صاحب العمل نفسه، فإننا لم نلق بالمقابل أي دعوى افتراء ضد
أصحاب العمل، علما أن اللجوء الى هذه الدعاوى بات ضرورة لوقف هذه الممارسة
البشعة في اتهام هذه الفئة المستضعفة بالسرقة. وقد عزا عدد من القضاة ذلك
الى تقاعس النيابة العامة عن التحرك رغم إحالة الملفات اليها. وفي هذا
الإطار، كانت المفكرة قد نشرت في عددها الرابع.. تعليقا على <a href="http://www.legal-agenda.com/newsarticle.php?id=80&folder=legalnews&lang=ar">حكم</a> صادر عن القاضي المنفرد الجزائي في البترون في العام 2010. بتغريم صاحب العمل لتعسفه في استعمال حق الادعاء بعدما ثبت له التناقض<strong>"الواضح والفادح والفاضح</strong><strong><span dir="LTR">"</span></strong>في أقواله<a href="http://legal-agenda.com/print.php?id=465&folder=articles&lang=ar#_ftn3" name="_ftnref3" title=""><sup class="tiny">[3]</sup></a>. <br /><br />
<br /><br />
<strong>تهميش أسباب الترك وروابط التعسف والاستغلال </strong>في هذا الخصوص، تجدر الإشارة الى أن 191 حكما من أصل <span dir="LTR">210</span>حكما
موضوع الدراسة جاءت على شكل صفحة واحدة تتألف من نموذج حكم مطبوع مسبقا
يتم ملء المعلومات الشخصية عليه (كالاسم والجنسية) ونوع العقوبة ومقدارها،
من دون أي تفصيل لحيثيات القضية أو تعليل قانوني للأسباب الموجبة التي
ارتكز عليها القاضي في إصدار حكمه.<br /><br />
وانطلاقا من ذلك، نرى أن هذه الأحكام تنتهي الى إدانة العاملات فور التثبت
من واقعة الفرار أو الترك والامتناع عن إبلاغ السلطات العامة بذلك، من دون
البحث في الأسباب التي دفعت المدعية الى ذلك، وتحديدا فيما إذا كانت أقدمت
على فعل "الفرار" أو الهرب بسبب خطر معين أو ردا على تعد أو إيذاء جسدي
ونفسي أو استغلال أو إخلال صاحب العمل بأي من شروطه والتزاماته وعلى رأسها
موجب عدم تسديد البدلات. والتطرق لأسباب الترك لا يفيد فقط في معرفة ما إذا
كان نتيجة أسباب قاهرة أو بدافع الضرورة بل أيضا في معرفة ما إذا كانت
عاملة المنزل قد تعرضت لأفعال تجعلها ضحية اتجار، ما يسمح لها بالتبرر من
الملاحقة سندا للمادة 586-(8) الجديدة من قانون العقوبات تبعا لقانون تجريم
الاتجار بالبشر. وبذلك، يكون فعل الترك مجرما بمعزل عن أسبابه. <br /><br />
والتجاهل نفسه نلمحه بشأن شروط عقد العمل الموحد. فرغم أن هذا العقد يلزم
الصمت بشأن إجراءات الفسخ أو مفعوله على الوضع القانوني للعاملة، فإنه
بالمقابل يحدد بوضوح الحالات التي يكون للعاملة فيها حق فسخ العقد على
مسؤولية الكفيل، ويجدر التذكير هنا ب<a href="http://legal-agenda.com/article.php?id=388&lang=ar">مطالعة مفوض الحكومة</a>
في إحدى القضايا المقدمة من قبل عاملة في الخدمة المنزلية تطالب بأجورها
المستحقة التي تمنع الكفيل عن دفعها طوال ثلاثة أشهر، أمام مجلس العمل
التحكيمي في بيروت بحيث ورد في هذه المطالعة بأن مسؤولية فسخ العقد تقع على
العاملة بسبب "...فرارها" من المنزل<a href="http://legal-agenda.com/print.php?id=465&folder=articles&lang=ar#_ftn4" name="_ftnref4" title=""><sup class="tiny">[4]</sup></a>.<br /><br />
ولعله يكفي للتيقن من تهميش أسباب الترك، ومعها أفعال التعسف والاستغلال،
أن نتبين أن العاملات في الخدمة المنزلية كن في الـ210 حكما موضوع العينة،
هن الطرف المدعى عليه "بالجرم".<br /><br />
<strong>القضاء مرآة المجتمع وتهميشه لحقوق عاملات المنازل</strong><br /><br />
في رصدنا لبعض أعمال القضاء في مسائل تتعلق بعاملات المنازل، كنا نسعى
لمعرفة فيما إذا كان نجح القضاء في اتخاذ مواقف نقدية إزاء الآراء
الاجتماعية المسبقة التي يعانين منها، بحيث يأخذ بعين الاعتبار مختلف
العناصر التي تؤدي الى هذه النزاعات ضامنا لهن الحماية إزاء التعسف، فضلا
عن المحاكمة النزيهة والعادلة.<br /><br />
ونتيجة هذا الرصد، بدا أن القضاء في مثل هذه القضايا هو مرآة للمجتمع
وللأحكام المسبقة التمييزية ضد العاملات في الخدمة المنزلية الأجنبيات
السائدة فيه أكثر مما هو مساحة لإعادة النظر بها والتدقيق بها على ضوء
مبادئ العدالة والقانون. وإذ نسجل سعي بعض القضاة الى التملص من نظام
الكفالة المفروض عرفا أو أيضا الى الحد من الادعاء التعسفي بالسرقة، فإن
هذه المساعي تبقى جد محدودة وذات مفاعيل عملية تكاد تكون معدومة. فعبارة
فرار لا تزال رائجة، ومعاقبة ترك العمل أيضا ولو بمسميات مختلفة، وفيما يصح
أن قسما كبيرا من الادعاءات بالسرقة المرافقة للادعاء بالفرار تنتهي
بالبراءة، فإن أيا منها لم يتحول الى تهمة ضد صاحب العمل بالافتراء. أما
روابط الاستغلال والتعسف فهي تبقى مغيبة تماما في محاكمة الترك/الفرار.
وبذلك، تظهر تلك العاملات الفارات دوما، ليس على أنهن ضحايا ممارسات
وانتهاكات يتعرضن لها ويجبرهن على ترك أعمالهن بسببها كما هي الحال في
حالات كثيرة، بل على أنهن "مجرمات" يقترفن بتركهن لعملهن فعلا يصح في مجمل
الحالات تجريمهومعاقبته. وبذلك تتحول مخالفة عقد العمل – لو افترضنا أن
العاملة تركت عملها تعسفا – ليس الى نزاع عمل أمام مجلس العمل التحكيمي أو
دعوى مدنية على أساس المسؤولية التعاقدية، بل الى فعل ذي طبيعة جرمية يعاقب
بالحرمان من الحرية، غالبا لأشهر عدة. وهذا أمر، الى جانب عدم قانونيته
الواضحة، يبيّن بذاته التمييز ضد هذه الفئة من العمال، حيث لم تطرح هذه
المسألة يوما ولم يجرم أي عامل آخر على تركه لعمله. فالعمل علاقة تعاقدية
ولا يمكن أن يعاقب شخص جزائيا لعدم رغبته بالاستمرار في العقد، بل أقسى ما
يمكن أن يفرض عليه هو فسخ العقد والتعويض إذا تسبب ذلك بضرر للطرف الآخر،
لكن هذه ليست حال العاملة في الخدمة المنزلية.<br /><br />
وما نأمله هو أن يؤدي تحليل هذه الأحكام وتحويلها الى مادة دائمة للدراسة
الى تغيير الصور النمطية والدونية: فبذلك، وفقط بذلك، يؤدي القضاء وظيفته
الأساسية في تغليب العقل على الخرافات والغرائز.<br /><br />

يُناشد المركز اللبناني لحقوق الانسان المدعي العام ووزير الداخلية لوضع حد فوري للاحتجاز التعسفي وسوء المعاملة التي تجري في قصر عدل الجديدة، وتحملهما المسؤولية عن سلامة المحتجزين النفسية والجسدية.<br /><br />زار المركز اللبناني لحقوق الانسان، اليوم، الزنزانات في قصر عدل جديدة واكتشف برعب الظروف التي تعيش فيها ثلاثون امرأة أجنبية موقوفة.<br /><br />محتجزات إلى حد ستّة أشخاص في ستّة أمتار مكعّبة، تتم حراستهنّ من قبل رجال، دون أن يرون ضوء النهار، دون أن يخرجن من زنازنهنّ، دون ماء صالحة للشرب و يعتمدن بشكل كامل على الخارج لتأمين الغذاء لهنّ. إذا كانت إحداهنّ مريضة، يتوجّب على الحراس إبلاغ المخفر الذي أرسل المحتجزة إليهم والحصول على موافقته للتدخل. لا يوجد أي طبيب ولا أي منظمّة تقوم بزيارة هذه الزنزانات، وفقاً للمعلومات التي تمّ جمعها.<br /><br />يضيف لنا الحارس " ننتظر نقلهنّ إلى الأمن العام"،" إذا واحدة منهنّ ليس لديها غذاء، فإننا نجلب لها القليل من اللبن من عندنا". وامرأة من بنغلادش محتجزة هناك منذ 11 يوماً " لا أحد يجلب لها الطعام، فنعطيها بعض الشيء من الأكل من وقت للآخر" يضيف الحارس.<br /><br />وفقاً للمعلومات التي تمّ جمعها، لا ينبغي احتجاز السجناء أكثر من 4 أيام (والذي هو بالفعل أكثر من اللازم)، و لكن بعضهنّ يبقين إلى حد الشهر. ومن الواضح غياب الرقابة الأمنية والقانونية في هذه الأماكن.<br /><br />إنّ انتهاكات القانون اللبناني والتزامات لبنان الدولية لا تعد ولا تحصى وتشير مرّة أخرى الاحتقار الذي تكرّسه السلطات اللبنانية تجاه عاملات المنازل الأجنبيات وتجاه المحتجزين بشكل عام.<br /><br />بيروت في 12/حزيران/2013<br /></div>

The 23-year-old died by hanging using a rope in one of the rooms of her employer, the source said.<br />
According to one report, the worker was pregnant in her sixth month.<br />
Police were immediately dispatched to the scene.<br />

<a href="http://www.dailystar.com.lb/News/Local-News/2013/Jun-08/219744-recruitment-agencies-announce-code-of-conduct.ashx">The Daily Star, by Samya Kullab, June 08, 2013 </a>- BEIRUT: The Association of Owners of Recruitment Agencies in Lebanon has adopted a self-regulating code of conduct in a bid to protect the rights of migrant domestic workers, but the question of implementation, especially among recruitment agencies operating outside of the order, remains up in the air. “We are trying to put an end to the negative stereotype that haunts our industry,” explained Hisham Bourji, the association’s president, about his group’s decision to draft the code.<br /><br />The announcement of the move was made Thursday during a conference organized by the International Labor Organization, with the cooperation of the Labor Ministry.<br /><br />Bourji maintains that the association was already in the habit of following an implicit protocol for proper recruitment practices, but no one was paying<br />
<a name='more'></a> attention, he claimed.<br /><br />“And now, we have to pay the price with a bad reputation.”<br /><br />The principle reason to endorse the code publicly, he said, was to improve the order’s tainted image and assuage the concerns of the worker’s countries of origin, “so people know that we are trying,” to protect their rights.<br /><br />Under to the code, all recruitment agencies are obligated to protect their workers from all forms of discrimination, physical and sexual abuse and other forms of exploitation.<br /><br />Agencies are duty-bound to clarify worker and employment rights, and expected functions at the very beginning of the contract relationship.<br /><br />Those agencies that violate the code of conduct, by facilitating work placements leading to forced labor and exploitation for instance, would be blacklisted. Repeat offenders would have their company name circulated to the embassies of the countries of origin, local authorities and non-governmental organizations regularly.<br /><br />Recruiters are also responsible to report worker rights violations to the authorities, and must cover the travel expenses for workers with serious illnesses during the first three-month probation period, after which the employer bears these expenses.<br /><br />“The code of conduct is not enough by itself,” said Nidal Jurdi from the United Nations Office of the High Commissioner for Human Rights, the agency that commented on the code to ensure it adhered to international human rights standards.<br /><br />“Most of our suggestions were taken, some were not,” he said, adding that, ultimately, the state was the main “duty-bearer” concerning migrant worker rights.<br /><br />“The next step is to put in place effective implementation and monitoring mechanisms,” said Zeina Mezher, who is the National Project Coordinator of the ILO project Promoting Rights of Domestic Workers, which worked with the recruitment agencies to draft the protocol.<br /><br />Mezher clarified that because there were diverse understandings of what the code of conduct entails between the members of the association, the International Labor Organization considered it important to coordinate among them.<br /><br />“This doesn’t replace the importance of having strong legislation,” Mezher emphasized.<br /><br />Establishing a committee responsible to monitor the application of the code, which would also include a complaints procedure, was considered by all parties to be a key precondition to activating it.<br /><br />“But membership for the committee was not defined,” Mezher explained.<br /><br />Ideally, the committee would include a representative from the Labor Ministry, General Security, the association and two civil society organizations. A minor spat took place between Bourji and an official from General Security over the security body’s membership in the committee, as the official maintained that General Security had not been consulted over its joining the committee.<br /><br />However, not all agencies are happy about the code of conduct, since they believe that only rogue, unlicensed agencies have been guilty of abuses.<br /><br />“This is an injustice for recruitment agencies that have their papers in order,” said an agency owner who did not wish to be identified.<br /><br />“What about the hundreds of agencies that are operating without legal papers?” he said.<br /><br />As for bringing the rest of the sector under the purview of the code of conduct – Bourji estimated that half the 500 or so agencies operating in the country are unlicensed – only a Parliament-endorsed labor law can address this point.<br /><br />Bourji has maintained that the approval of a law drafted during Butros Harb’s tenure as labor minister would effectively control rogue agencies.<br /><br />“They are committing 90 percent of the abuses,” said Bourji.<br /><br />“No one wants to focus on this point. With the code of conduct, the ground has been prepared for this law to be implemented. Without this law, we have nothing.”<br /></div>
